THIS INCLUDED ALL NICOTINE AND COMMERCIAL TOBACCO PRODUCTS, INCLUDING ELECTRONIC CIGARETTES. CATS UNDERSTANDS COVID-19 HAS SHIFTED MANY PRIORITIES, INCLUDING T21, BUT WE ALL WANT TO REITERATE THE IMPORTANCE OF IMPLEMENTING ALL COMPONENTS OF THE T21 ORDINANCE, WHICH INCLUDED THE APPLICATION OF A TOBACCO RETAIL LICENSE FOR ALL TOBACCO RETAILERS THROUGHOUT FLAGSTAFF. A TOBACCO RETAIL LICENSE IS AN EFFECTIVE TOOL IN ENFORCING RULES ABOUT SELLING TOBACCO, INCLUDING T21. IT WOULD GIVE FLAGSTAFF AUTHORITY OVER HOW AND WHERE TOBACCO IS BEING SOLD WHILE ENFORCING CERTAIN CONDITIONS, SUCH AS YOUTH ACCESS AND SELLING TO THOSE UNDER 21 YEARS OLD. AS STATED IN THE ORDINANCE, THIS WOULD INCLUDE FINES AND SUSPENSION AND OR LOSS OF A LICENSE WHEN TOBACCO RETAILERS ARE NOT ABIDING BY LOCAL LAW. AS YOU'RE AWARE, THERE HAS BEEN MUCH DISCUSSION WITH WITHIN THE COMMUNITY THIS SUMMER ABOUT THE PROPOSED MOVE OF THE HOSPITAL TO THE SOUTHERN EDGE OF FLAGSTAFF CITY LIMITS. WHILE MANY OF THE CONCERNS EXPRESSED BY THE COMMUNITY ABOUT THIS MOVE WILL BE ANSWERED AS A PART OF THE NORTHERN ARIZONA HEALTH CARE APPLICATION PROCESS AND SUBSEQUENT NEIGHBORHOOD MEETINGS AND PUBLIC HEARINGS. TWO MAIN ISSUES DESERVE WIDE PUBLIC INPUT BEFORE ANY DECISIONS ARE MADE ABOUT THE RELOCATION OF THE HOSPITAL. WHAT ARE THE POSITIVE AND NEGATIVE IMPACTS ON THE COMMUNITY OF MOVING THE HOSPITAL FROM A CENTRAL LOCATION IN TOWN TO A LOCATION ON THE OUTSKIRTS OF THE CITY? AND WHAT WILL HAPPEN TO THE CURRENT HOSPITAL SITE IN NORTH BEAVER STREET? BOTH OF THESE ISSUES HAVE ENORMOUS IMPACT ON THE COMMUNITY AS A WHOLE, AND THEY DESERVE TO BE GIVEN THOROUGH CONSIDERATION. AMONG THE MANY QUESTIONS TO BE ANSWERED ARE WHAT ARE THE OPPORTUNITIES AFFORDED THE COMMUNITY BY THE HOSPITAL MOVED TO THE EDGE OF TOWN? WHAT ARE THE LIMITATIONS AND DRAWBACKS TO THE COMMUNITY OF MOVING THE HOSPITAL TO THE EDGE OF TOWN? WHAT ARE THE IMPACTS OF THIS MOVE ON THE CITY'S COMMITMENT TO SUSTAINABILITY, SMART GROWTH AND CLIMATE RESILIENCE? WHAT IS THE PLAN FOR THE CURRENT HOSPITAL SITE AND HOW DOES THAT PLAN FIT WITH OUR REGIONAL PLAN? WHAT IS THE PROPOSED TIMELINE AND HOW WILL IT ENSURE ADEQUATE COMMUNITY INPUT? THE PROPOSED RELOCATION OF THE HOSPITAL IS A SIGNIFICANT DEVELOPMENT THAT WILL DIRECTLY AFFECT MUCH OF THE POPULATION OF FLAGSTAFF, AS WELL AS THE CHARACTER OF OUR COMMUNITY. THE COMMUNITY NEEDS THE PROCESS OF EVALUATING THE HOSPITAL RELOCATION TO PROCEED AT A PACE THAT WILL ALLOW CONSIDERATION OF BOTH THE OPPORTUNITIES AND IMPACTS WITHIN THE ENTIRETY OF OUR CITY. THIS IS THE FUTURE AGENDA ITEM REQUEST, A CITIZEN'S PETITION SEEKING TO DECRIMINALIZE UNSHELTERED RESIDENTS. AND I'D LIKE TO INVITE THOSE COMMENTS DOWN TO THE STAND TO PRESENT. YEAH. GOOD AFTERNOON, MAYOR DEASY, COUNCIL MEMBERS. IN 2017, COMMUNITY MEMBERS, INCLUDING SOCIAL WORKERS, ACTIVISTS AND UNSHELTERED RESIDENTS ASK THE PREVIOUS COUNCIL TO REPEAL THE SECTION OF THE CITY CODE ENTITLED CAMPING ON PUBLIC PROPERTY WITHIN CITY LIMITS. THERE HAVE BEEN NEW DEVELOPMENTS. SO I'M HERE TO PRESENT FOUR REASONS TO REPEAL IT. IT IS UNCONSTITUTIONAL. IT IS CRUEL. IT IS DISCRIMINATORY AND IT IS COUNTERPRODUCTIVE. IN 2018, THE 9TH CIRCUIT COURT FOUND THAT A SIMILAR LAW IN BOISE VIOLATED THE EIGHTH AMENDMENT. THE SUPREME COURT HAS DECLINED TO TAKE THE CASE. BOISE SETTLED FOR ONE POINT EIGHT MILLION DOLLARS, NOT COUNTING LEGAL FEES FROM NEARLY A DECADE OF LITIGATION. FLAGSTAFF IS NOW VULNERABLE TO SIMILAR LAWSUITS AND EXPENSES IF YOU CHOOSE TO DEFEND AN UNCONSTITUTIONAL LAW. CRIMINALIZING SLEEP CONSTITUTES CRUEL AND UNUSUAL PUNISHMENT, ACCORDING TO THE NINTH CIRCUIT COURT. SLEEP DEPRIVATION IS TORTURE, ACCORDING TO THE GENEVA CONVENTION. IT CAUSES IMPAIRED JUDGMENT, DISORIENTATION, HALLUCINATIONS, PARANOIA AND PTSD AND EXACERBATES ALL KINDS OF ILLNESSES. LACK OF SLEEP MAKES IT DIFFICULT TO MAINTAIN EMPLOYMENT, PERFORM SELF CARE AND AVOID CONFLICT. WHEN POLICE ROUSE PEOPLE AND FORCE THEM TO MOVE ON REPEATEDLY, THIS IS HARMFUL AND DANGEROUS AND A VIOLATION OF INTERNATIONAL LAW. THE ORDINANCE DISPROPORTIONATELY AFFECTS THE MOST VULNERABLE. ABOUT 40 PERCENT OF UNSHELTERED YOUTH ARE LGBT. AMONG MOTHERS WITH CHILDREN EXPERIENCING HOMELESSNESS, OVER 80 PERCENT ARE FLEEING DOMESTIC ABUSE. YOUNG ADULTS WHO AGE OUT OF FOSTER CARE HAVE A 1 IN 11 CHANCE OF EXPERIENCING HOMELESSNESS IN ANY GIVEN YEAR. CRIMINALIZING HOMELESSNESS DISCRIMINATES AGAINST MARGINALIZED COMMUNITIES. THE ORDINANCE ALSO REQUIRES POLICE TO DISCRIMINATE DIRECTLY, QUOTE, THE ABOVE ACTIVITIES SHALL CONSTITUTE CAMPING WHEN IT REASONABLY APPEARS, IN LIGHT OF ALL THE CIRCUMSTANCES, THAT THE PARTICIPANTS ARE, IN FACT, USING THE AREA FOR LIVING ACCOMMODATION PURPOSES. CAMPING SHALL BE DISTINGUISHED FROM THOSE SHORT TERM USES, SUCH AS NAPPING AND PICNICKING. I'VE WITNESSED THIS PROFILING WHERE POLICE WILL HARASS ONE PERSON NAPPING WHO LOOKS HOMELESS WHILE IGNORING ANOTHER PERSON NAPPING IN THE SAME PARK AT THE SAME TIME WHO DOESN'T. AND FINALLY, THE ORDINANCE IS COUNTERPRODUCTIVE, CRIMINALIZATION EXACERBATES THE PROBLEM OF HOMELESSNESS, POLICE HARASSMENT WORSENS MENTAL HEALTH. [02:00:02] POLICE DON'T PRESERVE WHAT THEY PERCEIVE AS LITTER WHEN ARRESTING SOMEONE OR FORCING THEM TO FLEE. IDS PRESCRIPTIONS, ET CETERA, ARE OFTEN LOST AS A RESULT. SOCIAL SERVICES ARE OUT OF REACH WITHOUT ID AND MANY LANDLORDS AND JOBS RUN BACKGROUND CHECKS, SO SOMEONE WHO CAMPS OUT WHILE SAVING FOR AN APARTMENT MAY NEVER BE UNSHELTERED AGAIN. BUT IF THEY'RE JAILED OR FINED OR IF THEY LOSE THEIR BELONGINGS AND JOBS, THEY MAY BE CONDEMNED FOR LIFE. THIS COUNCIL MUST REPEAL SECTION 6-01-001-002 OF THE CITY CODE. THANK YOU. THANK YOU, MS. HOWEVER, I DO BELIEVE IF WE OPEN UP CAMPING, WE ARE GOING TO INCREASE THE NUMBER OF HOMELESS IN THIS COMMUNITY. LIKE I SAID BEFORE, WHEN I DIDN'T HAVE A MOMENT TO SPEAK, I'VE BEEN HERE FOR 25 YEARS, AND WE WILL INCREASE THE HOMELESS POPULATION FROM PHOENIX, FROM THEY WILL COME FROM PHOENIX, VEGAS. THEY WILL COME FROM ANYWHERE THEY CAN. THIS IS A BEAUTIFUL COMMUNITY AND A BEAUTIFUL PLACE TO CAMP. IT WILL NOT AFFECT FOREST HIGHLANDS, OTHER WEALTHY COMMUNITIES, CONTINENTAL, COCONINO ESTATES. IT WILL AFFECT THE COMMUNITIES THAT ARE ALREADY HURT MOST. IT WILL AFFECT SOUTH SIDE. IT WILL AFFECT SUNNYSIDE. IT WILL AFFECT DOWNTOWN. WE CANNOT LET CAMPERS AND PEOPLE CAMPING IN OUR COMMUNITY JUST TO CAMP IN OUR COMMUNITY. IT WILL CREATE A MUCH BIGGER DRUG ABUSE POPULATION, AND I'M NOT SAYING ALL HOMELESS ARE DRUG ABUSERS. THAT IS NOT WHAT I'M SAYING. HOWEVER, THERE IS A VAST MAJORITY THAT ARE EITHER DRUG ABUSERS OR MENTALLY ILL. THAT SAID, IN OUR COMMUNITY IT WILL INCREASE THE CRIME. WE WILL INCREASE THE TRASH, WILL INCREASE HUMAN FECES. THOSE COMMUNITIES IN SUNNYSIDE, SOUTHSIDE, DOWNTOWN WILL HAVE TO DEAL WITH AND THE CITY WILL HAVE TO DEAL WITH THAT AS WELL. WE WILL ALSO PUT A BURDEN ON OUR POLICE, ON OUR FIRE, ON OUR EMTS. AND THIS WILL BECOME A HUGE BURDEN FOR US IN THREE TO FOUR YEARS. AND THE CITY WILL HAVE TO PAY TO CLEAN UP THE TRASH, THE CAMPERS THAT ARE BROKEN DOWN, AND WE WILL ALSO DECREASE OUR PROPERTY VALUES IN THOSE COMMUNITIES. IT WILL BE THOSE COMMUNITIES THAT WILL HAVE TO DEAL WITH IT. THEY WILL HAVE INCREASED CRIME. THEY'LL HAVE INCREASED TRASH, INCREASED HUMAN FECES. AND I AM NOT OK WITH THAT. IT WILL ALSO PUT A PUBLIC BURDEN ON OUR SOCIAL SYSTEMS THAT ARE SOCIAL POLICIES THAT ARE ALREADY HAVING A BURDEN. AND WE CANNOT BRING IN MORE HOMELESS INTO OUR COMMUNITY. THESE PEOPLE WILL COME FROM VEGAS, FROM PHOENIX, BECAUSE IT'S A BEAUTIFUL PLACE TO BE. WE ALL WANT TO BE HERE AND IT'S BETTER TO BE HOMELESS AND FLAGSTAFF IN THE SUMMER THAN IT IS IN PHOENIX. THEY WILL COME. NOT ONLY THAT, WE WILL ALSO INCREASE OUR FIRE HAZARD IF WE HAVE PEOPLE CAMPING ON THE BASE OF MCMILLAN I'M DONE. OK. SO THAT SAID, AS A COMMUNITY MEMBER, I AM NOT IN SUPPORT OF THIS. YOU KNOW, SINCE I'VE BEEN ON COUNCIL, WE'VE ALREADY DISCUSSED THIS ONCE, AND COUNCIL DECIDED FOR A LOT OF COMPLICATED REASONS THAT I WON'T GO INTO NOW, THAT WE SHOULD JUST KEEP THE LAW THE WAY IT IS. SO I CAN TELL FROM SOME OF THE EMAILS WE RECEIVED THAT OUR COMMUNITY'S UNDERSTANDING OF HOMELESSNESS AND THE IMPACT STEMMING FROM OUR LACK OF AFFORDABLE HOUSING IS QUITE VARIED. WHILE I UNDERSTAND THE CONCERN AND FRUSTRATION EXPRESSED THROUGH THIS PETITION, I DON'T BELIEVE THAT OVERTURNING THE BAN ON CAMPING IN THE CITY LIMITS SOLVES OUR FUNDAMENTAL PROBLEM. WE CAN AND MUST DO BETTER TO BRING HOUSING TO THE FOREFRONT OF OUR POLICYMAKING. WHEN THE CITY RECEIVES OUR AMERICAN RESCUE PLAN ACT FUNDS, I ASK US TO KEEP EMERGENCY SHELTER AND AFFORDABLE HOUSING FRONT AND CENTER OF THE DISCUSSION. I CALL ON ALL OF US TO LET CONGRESS KNOW THAT WE WANT THEM TO PASS THE INFRASTRUCTURE BILL AND IMPORTANTLY, THE BUILD BACK BETTER PLAN. THE INFRASTRUCTURE BILL CONTAINS SOME MONEY FOR HOUSING, BUT NOT ENOUGH TO MAKE THE CHANGE WE NEED TO SEE. CAN WE, I'M ASKING THIS OF MY COLLEAGUES, CAN WE CREATE AN EMERGENCY TASK FORCE AND OR BRING RELIEF PROVIDERS TOGETHER TO BRAINSTORM HOW FLAGSTAFF WILL ADDRESS OUR UNSHELTERED NEIGHBORS AND THE WAYS WE'RE NOT ADEQUATELY ADDRESSING THE NEED. AS THE PUBLIC WILL SEE WHEN THE 10 YEAR HOUSING PLAN DRAFT IS RELEASED. FLAGSTAFF HAS A SEVERE SHORTAGE OF HOUSING FOR VERY LOW INCOME INDIVIDUALS AND FAMILIES, AND THIS AS WELL AS EMERGENCY SHELTER MUST BE ADDRESSED. WHILE I DON'T THINK OVERTURNING THE CITY'S BAN ON CAMPING ON CITY PROPERTY IS THE ANSWER TO OUR HOUSING ISSUES, I WOULD LIKE TO SEE US EXPLORE CREATIVE OPTIONS. SOME THAT HAVE BEEN PROPOSED ARE ALLOWING CAMPING IN ONE AREA, BUILDING TINY HOUSES AS A VERY SHORT TERM SOLUTION TO EMERGENCY HOUSING. CAN WE FIND THE PARTNERS AND FIND THE MONEY TO PURCHASE A MOTEL? I REALIZE THERE ARE HURDLES TO THESE IDEAS, AND THIS IS WHY I'D LIKE TO SEE THESE AND OTHER IDEAS EXPLORED BY THE CITY. THE COUNTY RESIDENTS BOTH SHELTERED AND UNSHELTERED, OUR PARTNER ORGANIZATIONS AND ANYONE ELSE WHOSE INSIGHT WOULD BE HELPFUL. BUT I WILL SAY I AM VERY GRATEFUL TO OUR COMMUNITY AND TO MY COLLEAGUES FOR CONTINUALLY BRINGING THE SUBJECT UP, INFORMING ME AND HELPING ME ALONG THE WAY. AND I LOOK FORWARD TO THE FUTURE DISCUSSIONS. THE OTHER THING I WANT TO MENTION IS THAT TONIGHT IS THE FINAL NIGHT OF THE FLAGSTAFF BIRTH AND WOMEN'S CENTER, AND IT'S THE PURPLE BUILDING LITERALLY RIGHT ACROSS THE STREET BY THE LIBRARY. AND THEY WORKED HARD BRINGING BABIES INTO OUR COMMUNITY. AND I DID WORK THERE FOR A WHILE. AND PAULA JUST SAID, YOU KNOW, COVID KIND OF DID HER IN. AND I WANT TO REMIND EVERYONE THAT COVID HAS BEEN TOUGH. IT CONTINUES TO BE HARD ON OUR SMALL BUSINESS COMMUNITY, ON OUR FAMILIES, OUR TEACHERS, OUR STUDENTS. I DO WANT TO KEEP IN MIND THAT OUR WORKING CALENDAR, BECAUSE I HAVE THREE ITEMS ON THE QUEUE THAT HAVE RECEIVED AT LEAST THREE COUNCIL MEMBER SUPPORT MOVING FORWARD TO DISCUSS FURTHER DISCUSSION, THE DISCUSSION ON A COMPREHENSIVE COST RECOVERY COST RECOVERY POLICY, WHICH I HAD MENTIONED WITH PARKS AND RECREATION COMMISSION LAST WEEK. I UNDERSTAND THE CODE OF CONDUCT AND ETHICS STANDARDS WILL BE SCHEDULED PRETTY SOON FOR OUR CITY ATTORNEY. ALSO, MY FAIR, THAT HAS SOMETHING TO DO WITH REVIEWING THE TAX CODE WITH RESPECT TO EXEMPTIONS FOR NONPROFITS ON RENTAL, LEASING AND LICENSING OF [INAUDIBLE] PROPERTY, FOR NON-PROFITS WHO OFFER GROUP HOMES IN PARTICULAR, AND THEN THE OTHER ONE IS THE BOSS PROGRAM, AND I THINK WE HAVE FUNDED THAT FOR THIS FISCAL YEAR, IF ANY UPDATE OR A STATUS REPORT WILL BE GREATLY APPRECIATED IN THE FUTURE, AS WELL AS THE PLANS FOR WORKFORCE DEVELOPMENT PROGRAM.
