AMENDMENT TO THE ZONING CODE FOR THE RESIDENTIAL SUSTAINABLE BUILDING STANDARDS.

I'M JUST SORT OF FILLING IN AND AND TAKING SOME OF THESE ZONING CODE AMENDMENTS THROUGH THE PROCESS SORT OF ON AN INTERIM BASIS.

SO, YEAH, GO EASY ON ME.

I'M GOING TO MAKE THAT SLIDESHOW GO.

SO TONIGHT WE ARE HOLDING A WORK SESSION BEFORE THE PLANNING AND ZONING COMMISSION.

I WOULD TELL YOU THAT THIS WILL BE FOLLOWED UP WITH A PUBLIC HEARING AND THAT WILL BE FEBRUARY 9TH.

SO AT THE FEBRUARY 9TH MEETING, YOU WILL BE MAKING YOU'LL TAKE FORMAL ACTION ON THIS AMENDMENT. BUT TONIGHT IT'S JUST A WORK SESSION, A TIME FOR US TO DISCUSS WHAT THE PROPOSAL IS.

TAKE ANY OF YOUR FEEDBACK AND BASICALLY MAKE ANY NECESSARY CHANGES THAT YOU SEE AS IMPORTANT TO THIS PARTICULAR AMENDMENT.

THIS AMENDMENT IS IMPORTANT TO A PARTICULAR CASE RIGHT NOW THAT IS MOVING TO BUILDING PERMIT, SO IT IS A HIGH PRIORITY ITEM TO SEE MOVE FORWARD.

SO THIS IS AN AMENDMENT TO ZONING CODE SECTION 10 30 70 RESIDENTIAL SUSTAINABLE BUILDING STANDARDS. THIS IS OKEY DOKEY SCREEN MOVE.

THERE WE GO. SO THIS IS A PROPOSED AMENDMENT TO EXISTING STANDARDS.

AND JUST TO HIGHLIGHT THE BIG CHANGES, THE AMENDMENT REMOVES WHAT IS CURRENTLY CALLED THE HOME ENERGY RATING SYSTEM.

OR, YOU KNOW, THE LINGO AROUND THE OFFICE IS THE HERS STANDARD.

THERE'S A HERS 50 ENERGY EFFICIENCY STANDARD WITHIN THE CURRENT ZONING CODE THAT BASICALLY ALLOWS A DENSITY BONUS.

SO STAFF IS PROPOSING TO CHANGE OUT THE HER STANDARD WITH BASICALLY MORE UPDATED, MORE USEFUL TYPES OF STANDARDS AND CERTIFICATIONS.

SO THE PROPOSAL IS TO REPLACE THE HERS WITH AN ALL ELECTRIC, ENERGY EFFICIENT BUILDING AND BUILDINGS THAT ARE CONSTRUCTED TO COMPLY WITH THE U.S.

ENVIRONMENTAL PROTECTION AGENCY'S ENERGY STAR WATER SENSE AND OR THE INDOOR AIR PLUS CERTIFICATIONS. IN ADDITION, WE ARE INCORPORATING ELECTRIC VEHICLE SUPPLY EQUIPMENT PROVISIONS. WE ARE ALSO REVISING WASTE REDUCTION REQUIREMENTS AND ALLOWING THE PLANNING DIRECTOR TO ENTER INTO AN AGREEMENT WITH ANY PROPERTY OWNER THAT COMPLIES WITH THESE STANDARDS TO INCREASE THEIR RESIDENTIAL BY RESIDENTIAL DENSITY BY 25 PERCENT.

SO LET'S GO THROUGH THAT AMENDMENT IN REGARDS TO THIS PARTICULAR SECTION OF THE CODE, WE ARE AGAIN UPDATING THE PURPOSE BECAUSE THE PURPOSE DOES REFERENCE AND RELY ON THAT HERS 50 STANDARD.

SO WE ARE REMOVING THE REFERENCE AND BASICALLY PROVIDING JUST UPDATED INFORMATION FOR THE PURPOSE OF THIS PARTICULAR DIVISION.

AND THEN IN TERMS OF DENSITY BONUSES, AGAIN REMOVING THE HERS AND REPLACING IT WITH OTHER PROVISIONS. BUT THE 25 PERCENT IS CURRENTLY ALREADY IN PLACE.

AGAIN, IT IS MEETING A HERS 50 THAT GETS YOU THAT STANDARD AND YOU CAN YOU'LL SEE HERE SHORTLY WHAT WE'RE PROPOSING AND JENNY, IF AT ANY TIME I CAN'T SEE MY SCREEN, I CAN'T SEE THE CHAT. SO JENNY, IF I GET ANY OF THIS WRONG, PLEASE, PLEASE JUMP IN.

SO HERE IS AN OVERVIEW OF THE PROPOSED AMENDMENT IN TERMS OF THE MINIMUM STANDARDS.

THE MINIMUM STANDARDS COVER WATER RESOURCE PROTECTION PROVISIONS, TRANSPORTATION AND AIR QUALITY PROVISIONS, WASTE REDUCTION MANAGEMENT AND ALSO ENERGY EFFICIENCY.

IN TERMS OF THE WATER RESOURCE PROTECTION PROVISIONS THERE, THESE PROVISIONS PRIMARILY REMAIN THE SAME. HOWEVER, THEY'RE UPDATED TO INCLUDE ALL OF THE BUILDINGS WITHIN A RESIDENTIAL DEVELOPMENT OR JUST MAKING IT MORE SPECIFIC.

AND WE'RE JUST CLARIFYING VERSUS LITTLE TYPOGRAPHICAL OR MORE LANGUAGE BASED CHANGES RATHER THAN ANYTHING SUBSTANTIVE.

IN TERMS OF TRANSPORTATION AND AIR QUALITY PROVISIONS, THESE WILL NOW REQUIRE A DEVELOPMENT TO BE LOCATED WITHIN A QUARTER MILE OF A TRANSIT STOP OR ACCOMMODATE ELECTRIC VEHICLE CHARGING IN ORDER TO OBTAIN THIS TWENTY FIVE PERCENT DENSITY BONUS.

IN TERMS OF WASTE REDUCTION AND MANAGEMENT PROVISIONS.

THEY'VE BEEN REVISED TO INCORPORATE MATERIALS MANAGEMENT PLAN, AS WELL AS A CONSTRUCTION AND DEMOLITION WASTE MANAGEMENT PLAN.

THESE PLANS HAVE TO BE PREPARED IN ACCORDANCE WITH THE CHECKLISTS AND STANDARDS FROM THE SUSTAINABILITY DIVISION.

THEY ALSO HAVE TO BE APPROVED BY THE SUSTAINABILITY DIRECTOR OR THEIR DESIGNEE.

AND AGAIN, THE LAST ONE IS ENERGY EFFICIENCY PROVISIONS, WHICH NOW INCLUDES THREE OPTIONS IN PLACE OF THE FORMER HERS 50.

SO A DEVELOPER MAY CHOOSE ANY ONE OF THESE OPTIONS.

THEY CAN GO ALL ELECTRIC, THEY CAN DO ALL ELECTRIC, ENERGY EFFICIENT BUILDING, OR THEY CAN DO ALL ELECTRIC BUILDING THAT EARNS TRIPLE CERTIFICATION FOR ENERGY, WATER AND AIR QUALITY. AND IN TERMS OF THE RESIDENTIAL SUSTAINABLE BUILDING AGREEMENT, THE PROVISIONS OF THIS SECTION HAVE BEEN UPDATED TO ALLOW THE PLANNING DIRECTOR TO ENTER INTO AN AGREEMENT WITH A PROPERTY OWNER TO COMPLY WITH THE PROGRAM REQUIREMENTS TO OBTAIN A DENSITY BONUS.

SO THIS IS DIFFERENT.

IT'S NOT REALLY A DEVELOPMENT AGREEMENT, BUT IT IS A SEPARATE AGREEMENT THAT WOULD ACCOMPANY THAT DENSITY BONUS TO ENSURE THAT THE PROPERTY THROUGH TIME MAINTAINS AND MEETS THE STANDARDS FOR WHICH IT ACHIEVE THAT DENSITY BONUS.

AND LASTLY, THERE IS A NEW DEFINITION PLACED IN THE CODE THAT DEFINES ELECTRIC VEHICLE SUPPLY EQUIPMENT.

JENNY, DO YOU MIND IF I HAND THE MIC OVER TO YOU TO TALK ABOUT THE CARBON NEUTRALITY PLAN? NO, NOT AT ALL.

I JUST WANTED TO PRESENT REALLY QUICKLY.

THIS AMENDMENT WILL ALIGN REALLY NICELY, ACTUALLY WITH A NUMBER OF OUR TARGET AREAS, AS WELL AS THEIR DIFFERENT STRATEGIES AND EACH ONE OF THOSE.

AND SO THE FIRST THREE ARE HERE.

THE EQUITY ONE IS A LITTLE BIT DIFFERENT THAN MOST, JUST BECAUSE WE KNOW THAT THESE AMENDMENTS ARE ACTUALLY GOING TO HELP US.

THE HOUSING AMENDMENTS GET MOVED, YOU KNOW, MOVE THOSE FORWARD.

THIS HAS BEEN TALKED ABOUT FOR YEARS THAT THE HOUSING INCENTIVE AND THE SUSTAINABILITY INCENTIVE KIND OF CONFLICT AND SO THIS ACTUALLY WILL HELP US IN THAT WAY.

AND SO IT'S REALLY IMPORTANT FROM AN EQUITY STANDPOINT, DECREASE DEPENDENCE ON CARS.

THIS SPEAKS A LITTLE BIT ABOUT APPROPRIATE LOCATIONS AND LOCATING NEAR TRANSIT.

ELECTRIC MOBILITY IF YOU'RE NOT ABLE TO LOCATE NEAR TRANSIT, WE ASK THAT YOU HAVE EV CHARGERS. TIFFANY, WOULD YOU MIND GOING TO THE NEXT SLIDE? THANK YOU.

CLEAN ELECTRICITY, SO THIS IS A LITTLE BIT LESS CLEAR CUT, BUT SOME OF THE ENERGY EFFICIENCY ITEMS CAN BE PAIRED WITH CLEAN ELECTRICITY TO COMPLY WITH THE REQUIREMENTS OF THE INCENTIVE BUILDING.

FUEL SWITCHING IS A PRETTY IMPORTANT ONE IN THAT WE'RE REALLY TRYING TO INCENTIVIZE NEW BUILDINGS TO RELY ON THE ELECTRIC GRID AND THAT'S REALLY CRITICAL FOR OUR CARBON NEUTRALITY GOALS.

REDUCE BUILDING ENERGY, USE THE ENERGY EFFICIENCY REQUIREMENTS, MOVE US FURTHER, HELP US HAVE THIS BE A STRONGER INCENTIVE AND THEN SUSTAINABLE CONSUMPTION AND WASTE MANAGEMENT THAT ALIGNS WITH THE REQUIREMENTS OF THE CARBON NEUTRALITY PLAN AS WELL.

SO WE JUST SAW A LOT OF ALIGNMENT HERE, AND IT WAS A REALLY GREAT OPPORTUNITY TO BE ABLE TO SAY YES, THAT'S WHAT THESE INCENTIVES ARE FOR RIGHT THERE TO HELP US MOVE FORWARD WITH THESE GOALS IN WAYS THAT WE CAN'T NECESSARILY ON A CODE LEVEL OR WE'RE NOT READY TO.

SO WITH ALL THAT SAID, I JUST WANTED TO COVER REALLY QUICKLY WHAT THE FINDINGS ARE GOING TO BE FOR THE ZONING CODE TEXT AMENDMENT WHEN YOU ALL REVIEW THIS ON FEBRUARY 9TH AND THAT THE PROPOSED AMENDMENT DOES HAVE TO BE CONSISTENT AND CONFORM WITH THE OBJECTIVES AND POLICIES OF THE GENERAL PLAN, WHICH IS, OF COURSE, OUR REGIONAL PLAN.

THAT THE PROPOSED AMENDMENT IS NOT DETRIMENTAL TO THE PUBLIC INTEREST, HEALTH, SAFETY, CONVENIENCE OR WELFARE OF THE CITY, AND THAT THE PROPOSED AMENDMENT IS INTERNALLY CONSISTENT WITH OTHER APPLICABLE PROVISIONS OF THE ZONING CODE.

AND STAFF BELIEVES THAT WE'RE GOING TO MEET ALL OF THESE FINDINGS AND WE WILL BE PREPARED TO GO THROUGH THE FINDING MORE FINDINGS AND MORE DETAIL ON FEBRUARY 9TH.

AND SO NOW JUST REALLY WANT TO OPEN AT THIS TOPIC UP FOR QUESTIONS, COMMENTS, SUGGESTIONS BETWEEN STAFF AND THE COMMISSION.

I KNOW, YOU KNOW, JENNY IS IS SUCH THE EXPERT THAT I RELY ON.

SHE'S BEEN SO FUNDAMENTAL IN MAKING THIS A SUCCESSFUL CODE AMENDMENT.

WE ARE NOT ACTUALLY CLAIMING THE WE HAVE NOT DONE THE EMISSIONS CALCULATION AND THOSE WOULD BE DIFFERENT ON EVERY SINGLE DEVELOPMENT, RIGHT? HAS VERY, VERY DIFFERENT EMISSIONS CALCULATION BASED ON THE SIZE OF THE BUILDING BASED ON WHERE IT IS, ET CETERA, ET CETERA.

SO WE'RE NOT ACTUALLY CLAIMING THAT THIS IS GOING TO LEAD TO AN EMISSIONS REDUCTION OF A CERTAIN MAGNITUDE.

WHEN YOU LOOK AT ALL OF THESE DIFFERENT ELEMENTS, RIGHT, AND ALL OF THESE DIFFERENT THINGS, WHAT WE CAN DO IS CONTROL WHAT WE CAN CONTROL, RIGHT? WE CAN LOOK AT THE ENERGY EFFICIENCY OF THE BUILDINGS, ET CETERA.

FROM A MORE PEOPLE PERSPECTIVE, YOU KNOW, WE THAT IT'S NOT ACTUALLY BLACK AND WHITE, RIGHT? THIS COULD BE MORE PEOPLE THAT CAN LIVE IN FLAGSTAFF INSTEAD OF [INAUDIBLE] PARK, RIGHT, OR INSTEAD OF WINSLOW AND WILLIAMS. AND SO THAT MAY ACTUALLY LEAD TO LOWER GREENHOUSE GAS EMISSIONS ON A REGIONAL OR GLOBAL LEVEL, RIGHT? IT CAN GET REALLY DANGEROUS.

IF YOU KNOW WE SAY, WELL, YOU KNOW, WE CAN'T HAVE ANY MORE PEOPLE BECAUSE WE CAN'T HAVE OUR EMISSIONS GROW. WE HAVE TO LOOK AT IT AT THAT BIGGER REGIONAL LEVEL, EVEN IF THAT'S NOT WHERE OUR POLICY CONTROL IS, IF THAT MAKES SENSE.

DOES THAT HELP ANSWER THE QUESTION? YEAH. AND THAT'S WHAT I WAS WONDERING, BECAUSE I'VE LOOKED AT A FEW DIFFERENT MODELS, AND THAT'S WHAT I WAS SAYING. I KNOW THIS IS TRICKY WATERS AND THE WORK THAT YOU ALL IN SUSTAINABILITY HAVE DONE TO KEEP COMING BACK TO THE DRAWING BOARD WHEN WE'RE TRYING TO UPDATE MODELS, IT SEEMS EVERY YEAR.

BUT YEAH, THAT'S THAT'S JUST KIND OF WHAT I'M GETTING AT.

YOU KNOW, HOW DO WE OVERALL REDUCE CARBON EMISSIONS AND THE DENSITY BONUS? YOU KNOW, I CAN SEE A LOT OF BENEFITS IN THAT.

LIKE YOU WERE MENTIONING, IF PEOPLE ARE FURTHER AWAY AND THEY'RE COMING IN, THEN THAT THAT'S A DIFFERENT DYNAMIC ALTOGETHER.

CAN YOU GO INTO A LITTLE MORE DETAIL ON HOW THAT WORKS IN TERMS OF LIKE ENFORCEMENT? HOW DO YOU HOW IS THAT? HOW DO YOU CHECK UP ON PROJECTS THAT ARE ALREADY HAVE ALREADY BEEN BUILT AND ARE OPERATING? AND PROBABLY AS WE GO THROUGH THIS PROCESS, WE ALSO PROBABLY NEED TO IMPLEMENT MORE POLICY AND PROCEDURE ON OUR END AS WELL IN TERMS OF HOW WE IMPLEMENT THIS.

AND SO WE ALWAYS LIKE TO WRAP UP A ZONING CODE TEXT AMENDMENT FOR HOW WE'RE GOING TO INTERNALLY DO THAT.

AND I DON'T NECESSARILY HAVE ALL OF THOSE ANSWERS RIGHT NOW.

WE'VE ONLY EVER HAD A COUPLE OF PROJECTS FOLLOW THROUGH WITH THIS WITH THIS DENSITY BONUS. IN THE PAST, IT WAS SO SIMPLE.

AND CURRENTLY, IT'S BEEN FAIRLY SIMPLE TO GET THIS DENSITY BONUS BY ONLY MEETING THOSE STANDARDS THAT I WAS ABLE TO JUST DOCUMENT A FILE THAT THEY'VE HAD THEIR TEST FOR THE

ARE THERE ANY OTHER COMMISSIONERS WITH SOME COMMENTS OR QUESTIONS ON THIS? SO I DID WANT TO MENTION THAT I DID RECEIVE A PUBLIC COMMENT FROM A FORMER COMMISSIONER, DAVID CARPENTER, WHO IS ALSO A LOCAL DEVELOPER.

HE ACTUALLY PLAYED A BIG HAND IN WRITING THESE ORIGINAL TEXT AMENDMENTS, AND HE WAS VERY EXCITED ABOUT THIS PROPOSAL.

HE THOUGHT IT WAS A VAST IMPROVEMENT, AND HE WAS ALSO ENCOURAGING US TO FURTHER THIS AND INCLUDE IT FOR FUTURE COMMERCIAL DEVELOPMENT AS WELL.

SO I JUST WANTED TO PASS ALONG THOSE COMMENTS.

AND MARIE, I'M GOING TO PUT MY BRAIN TO THE ISSUE OF ENFORCEMENT AND TRY TO HAVE MORE INFORMATION FOR YOU ON FEBRUARY 9TH.

AND OF COURSE, THIS INCORPORATES MIXED USE, WHICH HAS SOME ELEMENT OF COMMERCIAL.

BUT WE WOULD HAVE TO COME UP WITH SOME OTHER OR SOME OTHER INCENTIVE, I GUESS, BUT I THINK IT'S ABSOLUTELY WORTH THE EFFORT TO SUPPORT THE CARBON NEUTRALITY PLAN AND MOVE THOSE IDEAS FORWARD.

I MEAN, A LOT OF THOSE THINGS WE WANT TO SEE ON DEVELOPMENT CASES.

WE COULD INCENTIVIZE THOSE THROUGH SOME OTHER MEANS.

THAT'S TRUE. RIGHT, I CAN SEE THAT.
