THANK YOU. SO WE DO HAVE A CITY CODE THAT COVERS SPECIFICS FOR THE SALARIES THAT ARE GIVEN BOTH TO OUR MAYOR AS WELL AS ALL OF OUR COUNCIL MEMBERS.

THIS CODE ALSO OUTLINES THE PROCESS THAT WE USE TO CONSIDER ANY CHANGES TO THAT SALARY, AND SO AS PART OF THAT PROCESS, THE CODE NAMES FIVE OF OUR COMMISSIONS WHERE WE ARE TO ASK A MEMBER FROM EACH OF THESE COMMISSIONS TO SERVE ON OUR CITIZEN COMMISSION FOR COUNCIL SALARIES.

WE HAD RECEIVED A REQUEST FROM MAYOR AND COUNCIL QUITE A TIME BACK.

IT WAS ACTUALLY THE PREVIOUS COUNCIL, BUT WE'VE BEEN STRUGGLING TO FILL THE FOUR COMMUNITY AT LARGE VACANCIES.

WE HAVE FINALLY ACCOMPLISHED THAT.

SO NOW WE ARE DOING OUR ROUNDS TO THE FIVE COMMISSION MEETINGS TO DETERMINE WHO FROM YOUR COMMISSION WOULD BE WILLING TO

SERVE ON THE CITIZEN COMMISSION FOR COUNCIL SALARIES.

THE GOAL OF THIS COMMISSION IS TO REVIEW SALARY INFORMATION AND THEN TO MAKE A RECOMMENDATION TO CITY COUNCIL.

THE PROCESS USUALLY TAKES ABOUT 2 TO 3 MEETINGS, AND THE MEETINGS ARE ABOUT AN HOUR IN LENGTH.

SO IT'S A SHORT TERM ASSIGNMENT, NOT AS SIGNIFICANT PROBABLY COMPARED TO THE WORK THAT YOU DO ON THIS COMMISSION, AS WELL AS A RECENT CITIZEN BOND COMMISSION. IT'S A MORE SHORT TERM ASSIGNMENT.

SO I'M HERE TODAY TO SEE WHO FROM THE PLANNING AND ZONING COMMISSION MIGHT BE WILLING TO SERVE IN THIS CAPACITY.

Preliminary Plat PZ-15-00015-24 Sirius at Timber Sky - Block 4 Capstone Homes requests Preliminary Plat approval for Sirius at Timber Sky - Block 4 located at 3191 McAllister Ranch Road, a 63 lot single-family subdivision on 21.82 acres in the Single-Family Residential (R1) Zone. STAFF RECOMMENDED ACTION: Staff recommends the Planning and Zoning Commission, in accordance with the findings presented in this report, forward the Preliminary Plat to the City Council with a recommendation of approval with the following conditions. The applicant shall provide the purpose of each tract on the final plat. The final plat shall show the patent as shown on Sheet 2 of the preliminary plat and on the Timber Sky Final Block Plat. All lots shown with less than a 60-foot lot width at the 25-foot front setback shall have building envelopes with front setbacks set at the point where the lot width is 60 feet. A note shall be added to the lot typical identifying which lots have alternative front setbacks.]

WE HAVE A REQUEST FROM CAPSTONE HOMES FOR PRELIMINARY PLAT APPROVAL OF SERIOUS SEPTEMBER SKY AS A SINGLE FAMILY SUBDIVISION OF A 21.2 ACRE BLOCK TO RESULT IN 63 LOTS IN THE R-1 ZONE WITHIN THE RESOURCE PROTECTION OVERLAY.

[INAUDIBLE] STAFF APPROVED THIS PRELIMINARY PLAT ON JUNE 7TH, 2022.

THERE ARE THREE CONDITIONS OF APPROVAL RECOMMENDED BY STAFF.

WE'LL GO OVER THE CONDITIONS THROUGHOUT THE PRESENTATION.

THE SUBJECT'S SITE IS LOCATED ON THE SOUTHEAST CORNER OF THE TIMBER SKY DEVELOPMENT AREA AT THE INTERSECTION OF MCALLISTER RANCH ROAD AND SOUTH WOODY MOUNTAIN ROAD AND ABUTS TIMBER SKY BLOCK 3B AND SKY COTTAGES TO THE NORTH.

TIMBER SKY BLOCK FIVE TO THE WEST AND PRESIDIO TO THE EAST.

THE SITE IS ALSO BUFFERED TO THE SOUTH BY I-40.

THE ANNEXATION AND ZONING MAP AMENDMENT WERE APPROVED FOR THE TIMBER SKY DEVELOPMENT IN 2016, WHICH PROPOSED A MAXIMUM OF 1300 RESIDENTIAL DWELLING UNITS.

THE SITE IS ENCUMBERED BY A FEDERAL PATENT ACROSS THE SOUTHEAST CORNER OF THE SITE.

THE DEVELOPABILITY OF LAND SUBJECT TO THE PATENT IS A MATTER BETWEEN THE APPLICANT, THE STATE AND THE FEDERAL GOVERNMENT.

THE APPLICANT HAS BEEN MADE AWARE OF THE ISSUE AND HAS PROVIDED AN OPINION FROM THEIR LEGAL COUNSEL THAT DEVELOPMENT CAN PROCEED.

THIS LEGAL OPINION HAS BEEN PROVIDED FOR YOUR CONSIDERATION.

THE CITY TAKES NO POSITION ON THE DEVELOPER ABILITY OF THE LAND.

STAFF IS RECOMMENDED AS A CONDITION OF APPROVAL THAT THE PATENT BE SHOWN ON THE FINAL PLAT.

THIS IS TO ADDRESS WHETHER THE TRACKS ARE TO BE CONSIDERED AS OPEN SPACE, STORM WATER RETENTION, ETC..

I STATED EARLIER THE SITE IS WITHIN THE RESOURCE PROTECTION OVERLAY.

RESOURCE PROTECTION HAS BEEN AVERAGED ACROSS THE TIMBER SKY DEVELOPMENT, WHICH IS TO BE UPDATED AS DEVELOPMENT IS REALIZED.

HOWEVER, THIS PROPOSAL DOES MEET THE REQUIRED 47.5% OF TREE PRESERVATION.

THE PROPOSAL CONFORMS WITH ZONING STANDARDS FOR THE R-1 ZONE WITH DENSITY BETWEEN TWO AND FIVE UNITS PER ACRE.

LOTS ARE DESIGNED TO MEET RESOURCE PROTECTION REQUIREMENTS USING BUILDING ENVELOPES.

LOTS MEET MINIMUM SIZE OF 6000 SQUARE FEET, RANGING FROM APPROXIMATELY 8400 SQUARE FEET AND TO 17,950 SQUARE FEET.

LOTS ALSO MEET WIDTH AND DEATH REQUIREMENTS.

NOT ALL LOTS MEET THEIR WIDTH REQUIREMENTS AT THE FRONT OF THE PROPERTY LINE.

WHERE THIS IS THE CASE, STAFF IS ALSO INCLUDED A RECOMMENDATION FOR CONDITION OF APPROVAL THAT THE FRONT SETBACK BE APPLIED WHERE THE LOT WIDTH REACHES 60 FEET. THE SETBACKS APPLIED TO CONFORM TO R-1 MINIMUM SETBACKS.

CULTURAL RESOURCE CLEARANCE WAS COMPLETED WITH THE ORIGINAL 2016 APPROVAL.

OPEN SPACE AND AMENITY AREA REQUIREMENTS HAVE BEEN PROVIDED WITHIN THE TIMBER SKY DEVELOPMENT.

HOWEVER, THIS SUBDIVISION DOES ALSO INCLUDE ADDITIONAL OPEN SPACE.

SIDEWALKS ARE PROVIDED THROUGHOUT THE SUBDIVISION.

THE PROPOSAL COMPLIES WITH ENGINEERING STANDARDS AND WILL BE CONFIRMED WITH SEVERAL ENGINEERING PLANS AS THIS IS A SUBDIVISION IN A LARGER SITE. THE TRAFFIC IMPACT ANALYSIS WAS COMPLETED WITH THE REZONING AND WAS NOT NECESSARY FOR THIS SUBDIVISION.

EIGHT INCH WATER AND SEWER LINES WILL PROVIDE SERVICE FOR EACH LOT.

REGIONAL STORM WATER DETENTION HAS BEEN PROVIDED FOR THE ENTIRE TIMBER SKY DEVELOPMENT, BUT LID IS INCLUDED IN TRACT OF THE SUBDIVISION.

TO CLARIFY FROM THE STAFF REPORT ON LOT DRAINAGE IS MANAGED BY INDIVIDUAL HOMEOWNERS WHILE DRAINAGE AND TRACKS ARE MANAGED BY THE HOA. THE PROPOSAL MEETS THE PRELIMINARY PLAT PROCEDURES AND APPLICATION REQUIREMENTS AS WELL AS MINIMUM SUBDIVISION IMPROVEMENTS, WHICH INCLUDE LOT STREET EASEMENT AND BLOCK DESIGN.

STAFF FINDS THAT THE PROPOSAL MEETS THE REQUIREMENTS OF THE ZONING CODE, SUBDIVISION CODE AND ENGINEERING STANDARDS STAFF RECOMMENDS APPROVAL ON THIS ITEM WITH THE CONDITIONS AS LISTED IN THE STAFF REPORT, AND WE DO HAVE THE APPLICANT HERE TO ANSWER QUESTIONS AS WELL.
