[A. Recommendation for abandonment of a portion of Hoskins Avenue public right of way south of 631 S. Fountaine Street. STAFF RECOMMENDED ACTION: City staff is seeking a recommendation from the Planning & Zoning Commission for abandonment of approximately 5,200 square feet of Hoskins Avenue public right of way south of 631 S. Fountaine Street, reserving the southern 20’ of Hoskins Avenue right of way to accommodate a planned Flagstaff Urban Trail System (FUTS) trail identified in the Regional Plan and the Active Transportation Master Plan. ]

THIS IS A RECOMMENDATION FOR ABANDONMENT OF A PORTION OF HOSKINS AVENUE.

MY NAME IS BRYCE DOTY.

I'M THE REAL ESTATE MANAGER FOR THE CITY.

TODAY I HAVE A BRIEF PRESENTATION FOR YOU REGARDING AN ABANDONMENT REQUEST MADE BY YOU FOR A PORTION OF THE UNUSED UNIMPROVED SECTION OF HOSKINS AVENUE.

SO WHY ARE WE HERE? WELL, UNDER CITY CODE, ANY ABANDONMENT REQUEST MUST FIRST RECEIVE A RECOMMENDATION BY PLANNING AND ZONING COMMISSION BEFORE COUNCIL CONSIDERATION.

SO PUT THIS IN PERSPECTIVE OF WHERE WE ARE IN THE CITY.

HOSKINS AVENUE IS IN THE SOUTH SIDE, REPRESENTED BY THIS YELLOW STAR DOWN HERE.

IT'S A TWO BLOCK EAST WEST STREET BOUNDED BY NAU TO THE WEST, AND THEN IT KIND OF DEAD ENDS INTO UNIMPROVED, RIGHT OF WAY TO THE EAST, ADJACENT TO AN UNDEVELOPED CITY PARCEL.

AND THEN LONE TREE PICKS BACK UP AFTER THE UNIMPROVED PORTION.

SO THAT'S WHERE WE'RE AT IN THE CITY TODAY.

WELL, FOR THOSE KEEPING SCORE AT HOME, THE COMMISSION DID HEAR AND RECOMMEND FOR ABANDONMENT A REQUEST LAST YEAR FOR ABANDONMENT OF UNIMPROVED PORTION BEHIND SIDEWALK ADJACENT TO 709 SOUTH O' LEARY.

SO THAT'S WHERE MY HAND IS RIGHT HERE.

SO WE DO HAVE SOME RECENT HISTORY OF ABANDONMENTS ON THIS STRETCH OF HOSKINS AVENUE.

TODAY WE ARE TALKING ABOUT THE UNIMPROVED SECTION OF RIGHT OF WAY EXTENDING BEYOND FOUNTAINE STREET.

AND SO REPRESENTED RIGHT HERE BY MY HAND OR BY THE CURSOR.

AND JUST TO GIVE YOU KIND OF A LITTLE LEGEND HERE, THIS LIME GREEN, THIS IS THE GIS FOR THE CITY.

THIS REPRESENTS THE CITY RIGHT OF WAY.

AND THAT'S JUST KIND OF THE LEGEND OF WHAT WE'RE LOOKING AT HERE TODAY.

THIS IS A REPRESENTATION OF WHAT WE ARE RECOMMENDING TODAY TO ABANDON.

AND THAT'S BASICALLY THE ENTIRETY OF THE RIGHT OF WAY, RESERVING 20 FEET OF THE SOUTHERN RIGHT OF WAY FOR EXISTING AND FUTURE PUBLIC USES.

ALL RIGHT. HERE'S THE GOOGLE UNCANNY VALLEY ANGLE, WHICH IS A LITTLE BUTCHERED, BUT YOU CAN KIND OF SEE WE'RE TALKING ABOUT THIS PARKING PAVER PAVER LOT THAT IS CURRENTLY IS RIGHT AWAY RIGHT NOW, BUT IT'S NOT FULLY FUNCTIONING FOR PUBLIC PURPOSES.

RIGHT BEHIND IT, LOOKING WEST, THIS IS MOUNTAIN VIEW.

SO WE'RE KIND OF ALL LOOKING WEST DOWN THIS WAY.

HERE'S THE STREET VIEW AGAIN, THIS STRETCH, WHAT WE'RE TALKING ABOUT TODAY IS THIS PARKING LOT.

THE RIGHT OF WAY IS CURRENTLY BEING USED FOR THE ADJACENT HOME NAU OPERATES THIS HOME FOR VISITING FACULTY.

YOU'LL NOTICE THAT BRICK WALL BEHIND THE RIGHT OF WAY IS B IS WHERE MOUNTAIN VIEW TERMINATES INTO THE PARKING STRUCTURE RIGHT BEHIND ON CAMPUS.

SO THIS CODE REQUIRES US FOR ANY ABANDONMENTS TO PREPARE A REPORT ON WHETHER THE ADVANCEMENT IS CONSISTENT WITH EXISTING PLANS AND ALSO FOR STAFF TO MAKE REPORT RECOMMENDATION ON THE ABANDONMENT.

SO STAFF FINDS THAT THERE ARE NO RESTRICTIONS ON ABANDONMENT AND IS NOT INCONSISTENT WITH ANY EXISTING REGIONAL SPECIFIC PLANS OR STANDARDS. SO THAT'S THE FIRST FINDING.

SECOND FINDING IS EXISTING USES FOR THE RIGHT OF WAY.

RIGHT HERE, THESE BLUE LINES ARE THE WATER INFRASTRUCTURE FOR THE CITY, AND WE DO HAVE EXISTING WATER INFRASTRUCTURE WITHIN THAT SOUTHERN 20 FEET OF RIGHT OF WAY, WHICH IS ONE OF THE REASONS THAT WE DO NOT RECOMMEND ABANDONING ANY OF THAT PORTION.

AND THEN ANOTHER FINDING OR ANALYSIS IS FOR ANY IDENTIFIED FUTURE PUBLIC USES.

IN 1996, THE CITY DID ACQUIRE AN EASEMENT, A ROADWAY EASEMENT FROM NAU FOR BASIC TO MAKE A CONNECTION FROM HOSKINS DOWN INTO THE CEMETERY.

THAT'S NO LONGER SOMETHING THAT'S BEING PLANNED OR PROGRAMED OR CONSIDERED.

INSTEAD, THE FUTURE PUBLIC USE IS REALLY TO MAKE A CONNECTION BETWEEN THE FOOT TRAILS IDENTIFIED FUTURE FOOT TRAILS IDENTIFIED IN THE REGIONAL PLAN.

AND SO WE'RE LOOKING AT THAT SAME STRETCH OF HOSKINS RIGHT HERE.

ON THE REGIONAL PLAN, WE'VE GOT AN IDENTIFIED A FOOT TRAIL ON THE EAST OF IT AND ON THE WEST OF IT AND TO THE EAST OF IT.

AND WE WANT TO PRESERVE THE ABILITY TO MAKE THAT CONNECTION HERE.

AND THEN FINALLY, THE OTHER FINDING IS HOW IS THIS GOING TO IMPACT EXISTING UTILITIES? WE DID REACH OUT FOR UTILITY CLEARANCE.

APS APPROVED THIS WITHOUT CONDITIONS, AND UNISOURCE SAID THAT THERE WAS NO FACILITIES WITHIN THAT PORTION OF RIGHT OF WAY.

SO BASED ON THESE FINDINGS, STAFF RECOMMENDS TO ABANDON THE PUBLIC RIGHT OF WAY SOUTH OF 631 SOUTH FOUNTAINE STREET, RESERVING THE SOUTHERN 20 FEET FOR EXISTING AND IDENTIFIED FUTURE PUBLIC USES.

WITH THE COMMISSION'S RECOMMENDATION, STAFF WILL TAKE THE REQUEST TO COUNCIL FOR HEARING.

THE STAFF. THE CITY HAS AN ACTIVE INTER-GOVERNMENTAL AGREEMENT WITH NAU IDENTIFYING NECESSARY PROPERTY EXCHANGES BETWEEN THE CITY.

AND IF THIS ABANDONMENT IS APPROVED, WE WILL CONVEY THROUGH THAT EXISTING IGA IN EXCHANGE FOR REAL PROPERTY OF A SUBSTANTIALLY EQUAL VALUE THAT THE CITY IDENTIFIES AS NEEDED.

SOME OF THOSE IDENTIFIED CITY NEEDED NEEDS FROM NAU ARE: ONE THE RIGHTS TO CONSTRUCT [INAUDIBLE] UNIVERSITY IMPROVEMENTS OFF OF UNIVERSITY AND MILTON SOME SOME STRETCHES OF NAU PROPERTY ON LONE TREE FOR EXPANSION PURPOSES, AND THEN SOME IDENTIFIED FOOT TRAILS THROUGH CAMPUS.

SO SOME OF THOSE THOSE ARE SOME OF THE CONSIDERATION THAT WE WOULD PUT INTO THIS IGA FOR EXCHANGE OF THIS RIGHT AWAY.

SO, YEAH, WE DIDN'T REALLY HAVE A GOOD PLAN OF HOW TO MAKE THIS CONNECTION ON HOSKINS LAST YEAR WHEN WE WERE CONSIDERING THE ABANDONMENT OF THIS STAFF ACTUALLY, BECAUSE WE DIDN'T HAVE ANY UNDERSTANDING OF HOW THAT CONNECTION FROM THE HOSKINS TO CONNECT TO A FOOT TRAIL ON THE CEMETERY OR THROUGH THE CEMETERY RIGHT HERE, THROUGH THE CITY'S PROPERTY OVER HERE, WAS GOING TO BE MADE.

WE ACTUALLY RECOMMENDED NOT ABANDONING THIS RIGHT OF WAY.

COUNCIL DECIDED TO GO AHEAD AND ABANDON IT, WHICH MEANS THAT THE FOOT TRAIL IS GOING TO BE SOMETHING THAT'S GOING TO BE TAKEN UP WITH THE SOUTHERN PORTION OF HOSKINS.

SO NOW THAT WE KIND OF HAVE SOME DESIGN PARAMETERS, WE CAN PLAN FOR WHAT THAT LOOKS LIKE.

SO REALLY WHAT'S GOING TO BE MAKING THAT CONNECTION IS GOING TO BE ON THE SOUTH SIDE OF HOSKINS AVENUE.

OH, I'M SORRY. SO THAT YELLOW DOTTED LINE ON THE PREVIOUS GRAPHIC, THAT'S JUST GOING TO CONTINUE ON THROUGH THERE THEN.

CORRECT. ON THE ON THE SOUTHERN SIDE OF HOPKINS.

IS IT BASED ON SQUARE FOOTAGE AND SIZE OF THE LAND? MARKET VALUE OF THE LAND? JUST OUT OF CURIOSITY, I WONDERED HOW THAT WORKED FURTHER DOWN THE LINE.

WELL, AT THE END OF THE DAY, IT'S KIND OF JUST A MAINTENANCE.

SO IT'S I DON'T REALLY THINK IT MAKES SENSE TO GO APPLES TO APPLES FOR A SQUARE FOOT BASIS THERE.

SO THIS MIGHT BE MORE OF HOW MUCH MAINTENANCE LIABILITIES WITH THE CITY BE TAKING ON IN THAT EXCHANGE.

SO WE'RE STILL WORKING OUT THOSE KIND OF CONSIDERATIONS WITHIN NAU, BUT WE WANT TO THIS HAS BEEN SOMETHING THAT THEY'VE IDENTIFIED FOR A WHILE AND SO WE WANTED TO GET THIS AS AN OPTION IF IT IS APPROVED TO BE PART OF THAT EXCHANGE MATRIX.
